Historic SC judgement decriminalises homosexuality in India

To witness history is a rare privilege in life. On 6 September 2018, we were all privileged to watch history in action, as India’s Supreme Court struck down a colonial-era law that made homosexuality a criminal offence. This long-awaited decision provided legal recognition to India’s LGBTQI community, which had fought a decade-long legal battle to claim its rights. Section 377, the law that was struck down, was introduced by the British colonial government in India in 1861. Ironically, England itself decriminalised homosexuality in 1967.

For decades, homosexual Indians have lived in fear of legal discrimination and punishment. The law violated the rights to life, liberty and equality that the Constitution guarantees to all Indians. At Mumbai Smiles, every day we work to empower marginalised people to live with dignity. We applaud this progressive ruling and look forward to its positive impact in our mission to bring human rights to many of our fellow citizens who suffer the ill-effects of discrimination and inequality every day.
